CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL

By placing an order electronically through this website, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as all other applicable laws in force regarding the sale and delivery of the purchased product.

Shipping fees, which constitute the delivery cost of the product, shall be paid by the buyers.

Each purchased product shall be delivered to the person and/or organization indicated by the buyer at the specified address, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with all relevant documents, such as warranty certificate and user manual, if applicable.

If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days from the moment this situation is learned. The total amount paid must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID

If the buyer fails to pay for the purchased product or if the payment transaction is cancelled in bank records, the seller’s obligation to deliver the product shall cease.

UNAUTHORIZED USE OF CREDIT CARD

If, after delivery of the product, it is determined that the buyer’s payment was made using a credit card unlawfully by unauthorized persons, and the price of the sold product is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs covered by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN CIRCUMSTANCES

If unforeseeable force majeure situations occur that prevent timely delivery of the product, the seller shall inform the buyer. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed.

If the buyer cancels the order and paid by cash, the refund will be issued within 14 days. If payment was made by credit card, the product refund will again be made to the bank within 14 days; however, it may take 2–3 weeks for the bank to reflect the refund in the buyer’s account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT

Before accepting delivery, the buyer must inspect the contracted goods/services; damaged or defective goods/services (such as dented, broken, or torn packaging) must not be accepted from the shipping company. Accepted goods/services will be considered free of damage.

After delivery, the buyer must protect the goods/services with due care. If the right of withdrawal will be exercised, the goods/services must not be used. The invoice must be returned along with the product.

RIGHT OF WITHDRAWAL

The buyer may exercise the right of withdrawal without assuming any legal or criminal liability and without providing any justification by rejecting the goods within 7 (seven) days from delivery to the buyer or to the person/organization designated by the buyer, provided that the seller is informed through the contact details below.

WITHDRAWAL PERIOD

If the purchase is for a service, the 7-day withdrawal period begins on the date the contract is signed. In service contracts where the service begins with the consumer’s approval before the withdrawal period ends, the right of withdrawal cannot be exercised.

The costs arising from the use of the right of withdrawal shall be borne by the seller.

To exercise the right of withdrawal, written notice must be sent to the seller by registered mail, fax, or email within 7 (seven) days, and the product must not fall under the "Products for Which the Right of Withdrawal Cannot Be Exercised" section of this contract.

EXERCISING THE RIGHT OF WITHDRAWAL

The following must be returned:

  • The invoice of the product delivered to the buyer or third party
    (If the invoice is issued to a company, the return must also include a return invoice issued by that company. Returns cannot be completed without a return invoice for corporate purchases.)

  • Return form

  • The product’s box, packaging, standard accessories (if any), complete and undamaged

RETURN CONDITIONS

The seller is obligated to refund the total amount and return all documents that place the buyer under debt within 10 days from receipt of the withdrawal notice, and to collect the product within 20 days.

If the value of the product decreases or return becomes impossible due to the buyer’s fault, the buyer must compensate the seller for damages proportional to their fault. However, the buyer is not responsible for changes or deterioration caused by proper use of the product within the withdrawal period.

If exercising the right of withdrawal causes the purchase amount to fall below the campaign minimum threshold, the discount applied under the campaign shall be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be used for:

  • Products prepared in line with the buyer's request or clearly personal needs

  • Underwear bottom pieces, swimsuits and bikini bottoms

  • Cosmetics, makeup products, disposable items

  • Perishable or near-expiry goods

  • Products whose packaging has been opened after delivery, making returns unsuitable for health and hygiene reasons

  • Products mixed with other items after delivery and impossible to separate

  • Periodicals such as newspapers and magazines (excluding subscription contracts)

  • Services performed instantly in electronic environment

  • Intangible items delivered instantly to the consumer

  • Audio or video recordings, books, digital content, software programs, data storage devices, computer consumables where the packaging has been opened by the buyer

Cosmetics, personal care products, underwear items, swimwear, books, software, DVDs, VCDs, CDs, cassettes, and stationery consumables (toners, cartridges, ribbons, etc.) must have unopened, untested, intact packaging to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES

If the buyer defaults when paying by credit card, they agree, declare, and undertake that they will pay interest under their credit card agreement with the bank and be responsible to the bank. In such cases, the bank may pursue legal action and claim expenses and attorney fees from the buyer.

In any event of default, the buyer accepts to compensate the seller for all damages and losses caused by delayed payment.
